What will the Supreme Court Punish Prashant Bhushan?
New Delhi, India;
Sesja is to
be announced by the Supreme Court for Prashant Bhushan, a senior lawyer found
guilty of contempt of court. Earlier, the Supreme Court gave Bhushan time to
reconsider his apology for his crime. After the completion of the two-day
period, Prashant Bhushan told the court again that he would not apologize for
his tweets as his soul was not allowing it. Bhushan, through his lawyer Kamini
Jaiswal on Monday told the Supreme Court that if he withdraws from his
statement and presents an insincere apology, it would be contempt with his own
consciousness.
The Court gave time to Consider the Statement
During the
hearing on August 20, the Supreme Court gave Prashant Bhushan two days to
reconsider his statement. Prashant Bhushan was told by the Supreme Court that
he did not apologize on his tweet in the statement he made in the court. The
Supreme Court asked Prashant Bhushan to reconsider his statement. The court
said that for those who admit their mistake, they are very soft. The court
later said in its order that we have given time to Prashant Bhushan to
apologize unconditionally if he is ready for this, he will have to submit an
apology letter by August 24. If an apology is presented, we will consider it on
25 August.

to Apologize to Supreme Court
The Central Government Said- Forgive
Attorney
General K.R. K. Venugopal urged the court to punish Prashant Bhushan. On this,
the court said that we have convicted them. Justice Arun Mishri told Venugopal,
'Do not give such an argument without seeing Bhushan's answer. See what he said
in his answer. His response reflects aggression, not a defense. We cannot forgive
them. It is not possible until Bhushan reconsiders his statement.
Bhushan Demanded to Postpone the Hearing on the Sentence
Prashant
Bhushan, through his lawyer Dushyant Dave, demanded the Supreme Court to
postpone the hearing on sentencing till a decision on the reconsideration
petition. Dave told the Supreme Court that a review petition is yet to be filed
in this case. On this demand, the Supreme Court told Bhushan, "We can
assure you that no action will be taken till your reconsideration petition is
decided." Bhushan told the court that arguments on contempt proceedings
against him should be heard by another bench. The Supreme Court rejected
Bhushan's demand for a hearing by the other bench on deciding the sentence.
Let's know who said during the hearing on August 20 ...
Prashant Bhushan Convicted
in a Contempt Case, know What can be Punished!!!
Prashant
Bhushan's lawyer Dushyant Dave - The sky will not break if the
court waits to hear the review petition. The reconsideration petition can also
be heard by another bench, there is no requirement that this bench (of Justice
Mishra) be heard.
Justice Gavai
told lawyer Dave - Rajiv Dhawan had said on August 17 that the
reconsideration petition is ready, so why didn't you file it?
Bhushan's lawyer
Dave - Reconsideration petition is my right. There is no
obligation that I file a review petition within 24 hours. The period for filing
a review petition is 30 days.
Dave - If you
stop till reconsideration, the sky will not fall. It is not necessary to hear
this bench reconsideration petition
Justice Gavai - Hearing will not be postponed.
Prashant Bhushan
- My tweets, on the basis of which a contempt of court has been
considered, are in fact my duty, nothing more. This should have been seen as an
effort to improve the institutions. What I have written is my personal opinion,
my belief, and opinion. It is my right to have these opinions and thoughts.
Quoting Mahatma
Gandhi's statement, he said - neither do I want mercy nor I am
demanding it. I don't want any generosity either. I am willing to take whatever
punishment the court will give me. Senior advocate Rajeev Dhawan argued in
defense of Prashant Bhushan, Prashant Bhushan had appeared before the court in
all the cases related to Bhushan's 2G, Call Block scam, Goa Mining, CVC
appointment so far. The court should look at the contribution of Prashant
Bhushan while sentencing.
Justice Arun Mishra - Welcome to good work. We appreciate your efforts in filing good cases. We are not against 'Fair Criticism'. Balance and moderation are very important. You are part of the system. In the excitement of doing so much, you should not cross the Lakshman Rekha. If you do not balance your comments, you will destroy the institution. We do not punish for contempt so easily. I have not held a single person guilty of contempt of court in my entire career. There is a Lakshman line for everything, you should not cross the Lakshman line.
